COMPETITION CONDITIONS

1. Definitions

The Organizer of the competition is FUN & ENJOY Production, s.r.o., registered office at Wenceslas Square 831/21, New Town (Prague 1), 110 00 Prague, IČO: 27426459, registered in the Business Register maintained by the Municipal Court in Prague, file No. C 111554, as the operator of Hot Peppers Prague and the "hotpeppersprague" profile on the social network Instagram.

Social network is Instagram – a social network operated by Meta Platforms.

Organizer profile: profile of "hotpeppersprague" on the Social network.

Any registered user of the Social network older than 18 years who has an active profile on the Social network, follows the Organizer's Profile and meets other competition conditions may be a participant of the competition.

The winners of the competition are Competitors randomly selected (drawn) by the Organizer after the end of the competition from all Competitors who correctly completed the Competition task listed under the given post with the competition.

 

2. Duration of the competition

Duration of the competition is always indicated under the competition entry on the Organizer's Profile in the description.

The Organizer will inform the winner of the prize no later than 10 days after the end of the competition via private message on Social network. After the end of the competition, the Organizer is entitled to publish the list of winners (names of the winners' profiles on Social network) on the Organizer's Profile on Social network.
             

3. General conditions of the competition

Participation in competition is voluntary and by participating the Competitor agrees to these terms and conditions. Each Competitor may participate only once. In order to participate in the competition, the Competitor must comply with the terms and conditions of the competition.

Employees and associates of the Organizer, the Organizer or any company belonging to the Organizer’s group, including their family members, are not eligible to enter the Competition.

The competition is not organized, sponsored, or administered by the operator of the Social network - Meta Platforms. The above mentioned company does not incur any obligations to the Organizer or to the Competitors

Competitors will participate in the competition by responding to the Instagram competition entry post on the Organizer's Profile according to the specific assignment published in the competition post.

 

4. Prizes and their delivery

The prize is always listed in the respective post of each competition.
The prize can be sent to any address or redeemed in person at the club.

The winners of the competition will be informed by the Organizer of their prize within 10 days of the end of the competition via private message on the Social Network and will be asked to provide their contact details for sending the prize - i.e. first name, last name, and delivery address.

In the event that the winner does not respond to the Organizer's invitation to communicate the method of delivery of the prize or to provide the details for sending the prize or does not provide the required information even within 5 working days from the date of the Organizer's invitation or the winner does not collect the prize sent and the prize is returned to the Organizer, the Organizer reserves the right to keep the prize at its discretion or to appoint an alternative winner in accordance with the competition conditions.

 

5. Rights and obligations of the Organizer

The Organizer reserves the right to interrupt, shorten, extend, or terminate the competition at any time, or to change the rules of the competition for serious reasons or for reasons of force majeure.

The Organizer reserves the right to delete any photo posted by a Competitor to a competition entry if it displays content prohibited by the Social network Terms and Conditions or violates any legal regulations, any intellectual property rights or good morals.

The competition Organizer is not responsible for delivery of prizes, the provision of incorrect or inaccurate information in connection with the Competition (whether caused by human error or technical fault) or for any technical or telecommunications difficulties or faults arising during the competition.

The Organizer is not responsible for the winner's failure to read a private message on the Social network notifying the winner of the prize or if the winner responds to the Organizer via a private message on the Social network.

If the Organizer reasonably suspects that the competitor or any other person who has or may have assisted the competitor to win the prize has acted fraudulently, dishonestly, or unfairly, or if such action occurs, the competitor will be excluded from the competition.

Neither participation nor winning the competition can be enforced by legal action.

Competition prizes cannot be paid out in cash or any other substitution at the winner's request.

Depiction of prizes on the Organizer's marketing materials is for illustrative purposes only.

The Organizer shall not be liable for any loss or damage to the prize during transport or for any damage that the prize or reward may cause the winner or other persons who use or benefit from the prize or reward.

 

6. Final Provisions

In the event of any conflict between the provisions of these Competition Terms and Conditions and the Promotional Materials relating to the Competition, or any ambiguity regarding the interpretation of the Competition Terms and Conditions or the Promotional Materials, the relevant provisions of these Competition Terms and Conditions shall prevail.

 

INFORMATION ON THE PROCESSING OF PERSONAL DATA

In the text below you will find information on the processing of personal data of Competitors in the context of competitions organized by Fun & Enjoy Production s.r.o. on the company's "hotpeppersprague" profile on the Social network Instagram (hereinafter referred to as the "Social network").

 

Personal data administrator

 

The Administrator of your personal data within the framework of the competition is Fun & Enjoy Production S.R.O., registered office at Wenceslas Square 831/21, New Town (Prague 1), 110 00 Prague, IČO: 27426459, registered with the Municipal Court in Prague, file No. C 111554/MSPH (hereinafter referred to as the "Administrator" or "Organizer"). The competitions are not directly organized, sponsored, or administered by the Social network operator - Meta Platforms, so the processing of personal data for the purpose of the competitions is carried out by the Organizer.

However, Meta Platforms is the Administrator of the personal data of all users and visitors of the Social network processed in the operation of the Social network in general and also in the operation of other Meta Platforms products. Please, also note that, when managing the Organizer's profile on the Social network, the Organizer and Meta Platforms may become joint Administrators of your personal data, given that the Social network provides the Organizer with the so-called "personal data" when operating the Organizer's profile. This includes, for example, information about the number of people or profiles that have viewed, commented on or responded to the Organizer's posts on the Organizer's Social network profile, aggregated anonymized demographic data - e.g. age, city, gender of such persons, etc.). However, Meta Platforms is primarily responsible for processing data from these reports.

For functionality and processing of data in the operation of the Social network, Meta Platforms uses small data files - cookies, which are automatically stored on your computer or device, unless you disable this directly through your browser settings. Scope, purpose and duration of the processing of personal data

 

We would like to inform you that in the context of the competitions, the Organizer of competitions will process your personal data in accordance with the law for the purpose of participation in the competition: tagging your profile on the Social network. For the purpose of sending the prize, the Organizer will process first name and last name of the winners and contact address that they will ask you for in case you become a winner. If you become a winner, the Organizer may include the name of your Social network profile in the list of winners published on the Organizer's Social network profile after the end of the competition. The Organizer will not process any further data about you in connection to the competition. Any photographs you may have added to the Organizer's social media profile in the context of the competition will be stored by the Organizer on its social media account only.

Participation in the competition is voluntary, however, it is not possible to participate without providing the above information. Without providing a delivery address, it is then not possible to hand over the relevant prize (if the winner requires the prize to be sent by post).

The personal data of the competitors will be processed no later than 3 months after the end of the competition and then it will be removed by the Organizer.

 

Method of processing personal data, administrators and recipients of personal data

 

Access to personal data is only granted to authorized personnel of the Organizer and only through approved access. Personal data will be processed by the Organizer only manually in electronic form. Personal data is not subject to automated decision-making or profiling by the Organizer. The data – first names, last names and contact addresses of the winners may be provided to the relevant carrier (Czech Post, Zásilkovna) for the purpose of sending the prize. The above does not affect the processing of personal data carried out by the Social network in the context of its operation.

 

Your rights as a data subject

 

If you wish to exercise your legal rights regarding personal data, you may contact the Organizer directly at the registered office address listed in point 1 of this information.

 

As a personal data subject, the competitor has the right to information about the processing of his/her personal data, the right to request access to, correction or deletion of personal data (in particular incorrect, incomplete and outdated personal data) and the right to an explanation from the Organizer regarding the processing of his/her personal data if the competitor finds or believes that the processing is being carried out in violation of the protection of his/her private and personal life or in violation of applicable law, and the right to request that the situation be rectified and remedied.

 

The competitor may also request a restriction of processing, withdraw consent to the processing of personal data, if granted, or object to the processing of the data (if the personal data is processed based on legitimate interest).

 

The competitor also has the right to portability of personal data to another Administrator, if permitted by law and technically feasible, and has the right to file a complaint against the processing of personal data with the supervisory authority, which is the Office for Personal Data Protection (www.uoou.cz).
